Legal Notice and Privacy Policy

Legal Notice

Attorney Advertising. This website is attorney advertising. The general information on this site is educational, not legal advice. Reading that information alone does not create an attorney-client relationship. An initial consultation is a separate, limited legal service with an attorney-client relationship for that service. Visia’s policy is to accept representation in an immigration matter beyond the consultation through a separate written agreement signed by both parties. This policy does not remove professional duties that may already have arisen.

Prior results do not guarantee a similar outcome in your case. Every immigration situation is different.

Joel A. Padilla is admitted to practice law in the State of New York. His practice is limited to federal immigration law.

Privacy Policy

Who we are. Visia Immigration Law, PLLC, 8280 Willow Oaks Corporate Dr, Ste 600, Fairfax, VA 22031. Email: jp@visiaimmigration.com. Phone: (703) 344-7314.

What information we receive

  • Information you give us: when you call us, message us on WhatsApp or by email, book a consultation, pay, complete the pre-consultation questionnaire, or share information during a consultation or representation. Booking asks for your name, email, and an optional answer. It also records the appointment date and time and your time zone.
  • Payments: you currently pay after the consultation through a Stripe link. When you pay through that link, you enter your card details in Stripe. Visia receives payment information, but not your full card number through that link. Don’t send us full card details by email or message.
  • Information collected automatically when you visit the site:
    • Technical logs: WP Engine and Cloudflare process technical information about visits, which may include your IP address, browser, referring page, and requested pages, to operate and protect the site. This information may be kept in server logs.
    • Cookies and browser storage: the site uses a cookie to remember your language, set to last up to a year, and a Cloudflare security check that may store a cookie. It also temporarily stores information in your browser about emoji support. We haven’t installed our own visitor analytics tools or advertising pixels; the external calendar described below does load third-party tools. In some browsers, WordPress may also request emoji images from WordPress.org.
    • The booking calendar: opening the booking page loads a Calendly calendar. Calendly and its providers may receive information about your device and visit before you type or book. Its tools include analytics, Google and Meta advertising, performance monitoring, and tools that may record interactions with the calendar. They may use cookies and other information stored in your browser. What loads or is stored may vary with your browser, location, and available preferences. See Calendly’s Privacy Notice. Calendly decides, based on your location, whether the embedded calendar shows a notice for choosing cookies; in many places, including much of the United States, it may not show one. Opening the calendar doesn’t mean you’ve chosen which cookies to accept.

If you’d rather avoid loading the calendar, you can request an appointment without opening the booking page, by phone or WhatsApp at (703) 344-7314, if that method is safe for you. This alternative does not prevent logs from other pages you visit or data processing by the service you use to contact us.

How we use it

To respond to your request, schedule and hold the consultation, check for conflicts of interest, evaluate your situation and provide legal services, process payments and refunds, communicate with you through the channels you authorize, meet professional and legal obligations, such as record-keeping and client accounts, and protect the security of the site. We don’t sell the information you give us for the consultation or give it to other companies to send you advertising. This does not mean browsing is free from tracking: the embedded calendar loads third-party analytics and advertising tools, as explained above.

Service providers we use

We use these providers to run the practice. Depending on the service you use, they receive or process information. Their terms and privacy policies describe their practices, which may include the provider’s own uses. This list does not mean that every provider receives your entire case file:

  • Calendly: consultation booking.
  • Stripe: payments.
  • Docketwise: questionnaires and case management.
  • Google Workspace: email.
  • WhatsApp Business: messaging.
  • Zoom: video consultations.
  • Grasshopper: phone.
  • WP Engine and Cloudflare: website hosting and security.

Confidentiality and security

Information you share with Visia to consult with the attorney is protected by professional confidentiality duties, including when Visia doesn’t take your case, subject to the exceptions in applicable rules. We have a duty to take reasonable steps to protect that information. This does not guarantee complete security or mean that information an outside service collects while you browse has the same protection.

Please don’t put sensitive case details in general website or booking fields. After a preliminary conflict check, we can agree on a method you consider safe for sharing the information needed for the consultation. You don’t need to provide a written account of abuse. You can tell us whether it is safe to leave messages, mention Visia, or send links, or whether you’d rather contact us yourself. No website or messaging service can guarantee privacy on a device or account that someone else can access.

How long we keep it

How long information is kept depends on its type and purpose. We consider what is needed for the consultation or representation, conflict checks, professional and legal duties, and handling claims. Information is therefore not always deleted when a consultation or case ends.

Providers may also keep information in their logs or backups under their own policies and applicable obligations. The period a provider lets you view on screen does not necessarily show when it deletes information from all its systems.

Your choices

You can ask about the information we hold about you, request a correction, or ask us to delete it. We will review your request under applicable rules and confidentiality duties. We may need to verify your identity safely. We may not be able to provide or delete all information, for example, if we must keep it under professional or legal obligations or protect someone else’s information. This does not limit any rights you have under applicable law.

You can email jp@visiaimmigration.com, if email is safe for you, or use the contact method we have already agreed on. Don’t send identity documents or sensitive details with your initial request. Tell us how we can respond safely.

Your browser may offer controls to limit cookies and other stored information, though some features may stop working. Those controls do not necessarily delete information Visia or others have already received. Calendly describes its own choices in its Privacy Notice. We cannot promise that all those controls will appear or work the same way in our embedded calendar.
